Terms of Service

1. Acceptance of Terms

By accessing or using Finding Poppy (the “Service”), including our mobile application and website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Account Registration

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You agree to provide accurate and complete information during registration
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Gameplay & Virtual Items

Finding Poppy is an augmented reality game. By using the Service, you understand and agree that:

  • Virtual items (Poppys, CatNip, cosmetics, incubators, etc.) have no real-world monetary value
  • Virtual items are licensed to you, not sold; we retain all ownership rights
  • We may modify, rebalance, or remove virtual items at any time to maintain game integrity
  • Trading of accounts or virtual items for real money is prohibited
  • You will not receive a refund for virtual items if your account is terminated for violations

5. In-App Purchases

The Service offers optional in-app purchases through the Apple App Store. All purchases are subject to Apple's terms and refund policies. Prices are displayed in your local currency before purchase. All sales are final unless otherwise required by applicable law or Apple's refund policy.

6. User Conduct

You agree not to:

  • Use cheats, exploits, automation software, bots, hacks, or unauthorized third-party tools
  • Modify, decompile, or reverse-engineer the Service
  • Harass, abuse, or threaten other players
  • Impersonate any person or entity
  • Use the Service for any illegal purpose
  • Interfere with or disrupt the Service or servers
  • GPS spoof or falsify your location data
  • Create multiple accounts to circumvent bans or gain unfair advantages
  • Engage in real-money trading of accounts or in-game items

7. Safety & Real-World Conduct

Finding Poppy involves real-world exploration. You agree to play responsibly and safely:

  • Always be aware of your surroundings while playing
  • Obey all traffic laws and local regulations
  • Do not trespass on private property
  • Do not play while driving or operating machinery
  • Play in safe, well-lit areas and use caution in unfamiliar locations
  • We are not responsible for injuries, accidents, or damages resulting from gameplay

8. Intellectual Property

All content in the Service — including but not limited to artwork, animations, character designs, game mechanics, text, music, and software — is owned by Finding Poppy or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. User-Generated Content

If you submit content to the Service (such as Clowder names, chat messages, or profile information), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service. You are solely responsible for content you submit and must not post content that is illegal, offensive, or infringes on others' rights.

10. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any downtime, data loss, or service interruptions.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDING POPPY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, disclaimers, and limitations of liability survive termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or our website. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
